DRAFT Minutes of the Planning Committee meeting held on Tuesday 9th January 2007 in Yelverton War Memorial Hall Hall at 7.30pm.

Also present 4 members of the public.

Mr E Hopkins, Mr S Thompson and Mr S Dunlop were present to make representation against the appeal application, J9497 – Willow, Meavy Lane, Yelverton.  Mr Hopkins provided the Members with a copy of the objections and points of concern raised by residents in Willowby Park.

Mrs Challiss proposed and it was agreed to bring forward item 4a on the agenda for discussion.  Appeal on refusal of planning application Willow, Meavy Lane, Yelverton. This was agreed.

4a). Appeal application, part garden, Willow, Meavy Lane, Yelverton. Following discussion and consideration of the points raised by the Mr Hopkins and residents of Willowby Park, Mr Osborn proposed and it was agreed to forward additional comments to the Appeal Inspector in support of the refusal of planning permission by Dartmoor National Park Authority. The following statement was agreed: The Council considers that the proposal is detrimental to the character and appearance of this part of the Dartmoor National Park by reason of the reduction or removal of the hedgerow and the unnecessary infill of an area not on an otherwise built-up road frontage. The proposed dwelling is not sympathetic to the layout and character of the site and its surroundings, and would appear to only satisfy open market demand and not the social and economic needs of the community for affordable housing as promoted by The Local Plan Policy HS1.  The proposed dwelling would result in additional traffic movement on a narrow road unsuitable for any increase in traffic flow. 
The Members fully support the reasons submitted by the Dartmoor National Park Authority for the refusal of the outline planning application for a dwelling in the gardens of Willow, Meavy Lane, Yelverton.  

9754/006. Stokehill Lodge, Stoke Hill Lane, Crapstone. New conservatory on the west side of the dwelling.
The Members raised no objections or comments on the application.
 
9757/2006. Daymar and Greenacres, Crapstone Road, Crapstone.  New development of 6 town houses and 6 flats.  Following discussion and consideration of the plans and letters of objection received from residents of Crapstone Mr Osborn proposed and it was agreed to submit the following comments: The Parish Council is concerned that in recent years the number of applications for the village of Crapstone that have received planning approval has resulted in an unacceptable increase in the density of development incompatible with the character and form of the village.
With regard to the current application for 6 town houses and 6 flats, the Parish Council considers that the overall layout and outline design represents too high a density of development out of scale with the layout and character of the surrounding sites in the village.   The adjacent dwellings to the left in Grimstone Terrace are set back off the road and are fronted by a small garden and a low wall, this is also the case with the houses in Lisbon Villas on the right side of the proposed development.  The development would therefore be out of keeping with this frontage style.
The proposal for parking and access to the site off the main road is considered unsafe; the main road through Crapstone,, although designated a minor road, is the main road leading from the A386 to Buckland Monachorum, with a high level of traffic movement at most times of the day. It is narrow in places and the number of cars that are regularly parked along its length hampers easy movement of traffic. The positioning of parking bays directly off this road is considered unsafe.
Currently, each time the bus halts at the bus stop it causes congestion, the relocation of the shelter as proposed does not improve the situation. The bus shelter is used by school children during term time, and it is considered that the redevelopment of the area creates an opportunity to provide a bus bay to allow the bus to pull off the main road, creating a safer environment for the children and other bus users, and reduce traffic congestion.
There are doubts as to whether the proposed access arrangement for emergency vehicles is adequate.
In making these comments the Parish Council has referred to the Local Plan Review Policies H22, H23 and H28 and it is considered that this application is contrary to these policies.

0373/2004.  Land at Beechfield Nursing Home, Yelverton – Construction of 18 over 55’s flats. Amended plans to the original application.  Omission of guest bedroom to incorporate the room into Flat 1; omit windows and install patio doors to dayroom on the south elevation; finish with cream render and white contrast band. The Members raised no objection to the proposal.

The Chariman invited Mr Butland to make his representation to the Members on the application for 12 local need housing.  Mr Butland referred to the need for diversification in local farming, and to the history of the development of the village.  He also pointed out that the Planning Inspector in the last Local Plan Review recommended the site for housing. The current application is within the building development boundary and a recent housing survey identified the need for 12 local need houses in the Parish.

The Members make no objection to the application.   This was carried unanimously by vote.

9696/2006. Crossways Livery Yard, Axtown Lane, Yelverton. Replacement of some and refurbishment of other loose boxes (with no total increase in number).  Erection of a new hay barn, and ancillary buildings.  The Members note that an additional dwelling, and shop is no longer included in this new application. The Members find no objection to the application.
9730/2006. Land at Yelverton Golf Driving Range, Crapstone.  Outline application for the erection of 12 local needs housing. Following discussion Mrs Mills proposed the following response: The recent WDBC Housing Survey supported the addition of 12 local need housing in the Parish provided applications met current planning requirements.  This application is outside of the development boundary, and Members object to the application.  This was carried on a vote of 3 abstentions and 6 in favour.

4 residents from Buckland Monachorum village.

The Chairman invited the residents to make their representation to the Members. The residents are concerned about the outline planning application 9494/2006. Although they acknowledge the need for this type of housing in the Parish this particular site is not considered suitable. The site is outside the development boundary, the access lane is narrow and not wide enough to enable service vehicles and lorries to pass through; there are no passing bays. A local footpath leads onto the lane which does not have a pavement, extra vehicle activity would create an additional safety hazard. The proposed site is higher than the lane and will cause drainage problems, the area already experiences problems following heavy rain fall. There are more suitable areas in the village that could be explored.

9494/2006. Land at Uppaton Farm, Buckland Monachorum. Outline application to provide 12 affordable houses. The Members recognise the need for this type of housing but consider that this particular location in the Parish is inappropriate due to the particularly poor access, lack of good public transport, and shopping facilities. The access has no pavement in front of Netherton Cottages, and is no more than a narrow track. Extra vehicle activity in this area is considered to be a safety hazard.

It should be noted that surface water from the existing track and field flows down Uppaton Lane into the village and the provision of extra tarmac and roof surfaces will only exacerbate this problem.

9497/2006. West Mill Manor, The Crescent, Crapstone. Proposed new dwelling and double garage with associated infrastructure. (Repositioning of dwelling to that approved in application 7192/2005). The proposed new location of the dwelling has an adverse architectural impact on the Victorian villa West Hill Manor. It would be too close to Rousette, which is not in keeping with the other houses in the area. It would appear that more trees would also require felling.

9527/2006. Woodcroft, Crapstone. Demolition of existing dwelling and erection of 14 assisted living units for over 55 year olds. Following a debate on the merits of the application Mrs Woollacott proposed that the following comment be submitted, this was passed on a vote of 5 for and 1 against:

The Members object to the height of the proposed building which is considered too intrusive. The architectural design is not compatible with existing dwellings in the area. It is considered that the building should be reduced in height and number of apartments.

a. Mr Wing submitted a report on the consultation document issued by the Local Government Information Unit on a revised version of ‘Planning Simplified’. The Members were not surprised to learn that the designated consultation period for the submission of a response was very short (2-3 weeks) and that in fact a draft revised version was already in print, and a finalised document due for production in the Autumn. It was agreed that any response would have very little impact on the contents of the final document.

b. A Notice of an appeal has been received in respect of refusal of full planning permission on 0111/06 – Formation of a new driveway and erection of a new hedge bank, gatepost and gates at Higher Lake Farm, Lake Lane, Dousland.

c. It is noted that the work to erect a new telephone mast in replacement of a street lamp near the roundabout at Yelverton has not been completed. The DNPA enforcement officer has reported that communication is ongoing between the Orange PCS Ltd and DCC Highways. More information is awaited.

d. It is noted that a direction post is missing near Pound at Yelverton. The Clerk will contact DCC Highways.

The Chairman invited Mr Salt to make his representation on planning application 9208/2006 to the Members. Mr Salt referred to his letter of objection which has been copied to the Parish Council, and also pointed out that the application 9208/2006 is in fact retrospective, the alterations to the property were started some months ago, and completed before the application was submitted. There are a number of supporting documents submitted with the application; many of the facts contained in these are inaccurate. The original estate agents engaged by the shop owners are not mentioned, these were Mansbridge & Balment (Yelverton) and Connells (Plymouth), and the original selling price was inflated at £225,000 when taking into consideration that the original purchase price (according to the documents) was £179,950. Mr Salt also referred to the current West Devon Borough Council’s campaign to encourage the continued use of small post offices and the retention of these services in local communities.

Mrs Garton referred to Mr Salt's letter asking for the Borough Councillor to refer the matter to the Planning Committee and commented that there was no point in doing this at this moment in time if the Borough Council intended to refuse the application.

Mr Eales from Yelverton acted as spokesman for the local residents concerned about planning applications 0161/06 & 0162/06. The main concerns were the visual impact of the meters, the detrimental economic effect on local businesses, the possible damage caused to surrounding moorland due to drivers seeking alternative parking sites, the possible effect on the use of the recycling bins currently situated in the Leg O’Murron car park, the impact it will have on the local play park which is situated adjacent to the car park, the impact on users of the local Church the access to which is through the St Paul’s car park. There are also a number of properties whose main entrances are off the Leg O’Mutton car park.

The Members strongly object to the proposal. The siting of parking meters and signs in this location will have a detrimental impact on the character and appearance of this part of Dartmoor, by reason of its visual impact. It will also detract from the amenity enjoyed by residents and local businesses by the introduction of parking fees that will restrict the otherwise free use of this part of the moor. The car park is adjacent to a well-used local play park and local newsagents hairdressers and restaurant. It will have no benefit to the economic activity of the area by reason of encouraging customers and visitors to abandon use of the area altogether, or encourage short-term customers (i.e. those stopping to purchase a paper/ hire a DVD) and users of the play park to seek alternative, less suitable, parking sites in more sensitive areas in the immediate vicinity.

The Members strongly object to the proposal. The siting of a parking meter and signs in this location will have a detrimental impact on the character and appearance of this part of Dartmoor, by reason of its visual impact. Church members and residents attending funerals and other activities associated with the church will be restricted in their use of the area. The local public conveniences are also located adjacent to this car park; the introduction of charges for stopping in this spot will be extremely inconvenient. Visitors will by virtue of losing this free amenity be encouraged to seek alternative, less suitable parking sites on the more sensitive areas in the immediate vicinity.

c). Letter from Dr Peter Murphy. Dr Murphy copied a letter of objection he had written to application 8276/05 that arrived after the Parish Council planning meeting to consider the application. He has written a further letter of concern that the time between the posting of the Notice by WDBC and the Parish Council meeting was not sufficient to enable letters to be forwarded to the Parish Council. The Parish Council receives the applications from the Authority and has to publicise and reply within a given time limit. This was correctly undertaken with Parish Council Notices being placed on the Parish notice boards prior to the Parish Council Planning meeting. Unfortunately the Parish Council has no control over the procedures followed by the WDBC, but the Authority does have its own legal procedures to follow. The Parish Council does not have power to grant or refuse planning permission, however the WDBC is required to consult with the Parish Council and must also take into account letters of objection raised by local residents. It is agreed that the Clerk will forward the letter of concern to WDBC for comment on the time scales used to inform both the Parish Council and members of the public.

d). Councillor Soul provided some information on the application for development of Crossways riding stables.

The permission for the mobile home had a condition attached that ‘should the viable use of the stables for commercial purposes cease, then the mobile home shall be removed from site’. The same condition could not be applied to a house. There would be considerable problems with traffic flow on the narrow access lane, the whole of which is shown on the Definitive Plan as Footpath 38. The Members draw your attention to a number of letters from local residents objecting to the development.
